Car Rental In Houston, Texas | Contract
This Vehicle Rental Agreement (“Agreement”) is entered into between FASTCAR RENTALCAR LLC, hereinafter referred to as the “Lessor,” and the customer identified in this document, hereinafter referred to as the “Lessee.” This Agreement sets forth the terms and conditions for car rental in Houston, Texas. By signing or accepting this Agreement, the Lessee acknowledges having read, understood, and agreed to all the terms and conditions described herein.
1. Purpose Of The Agreement
The Lessor provides the vehicle described herein to the Lessee on a rental basis, and the Lessee agrees to receive and use it under their sole responsibility during the agreed rental period. The Lessee agrees to return the vehicle in the same physical and mechanical condition in which it was received, except for normal wear and tear resulting from proper use. This Agreement applies to any car rental in Houston, Texas conducted by FASTCAR Rental Cars.
2. Lessee Identification
The Lessee declares that the information provided is true and authorizes its verification. The Lessee agrees that any false information will be grounds for immediate termination of the Agreement without refund of the deposit.
3. Lessee Responsibility
The Lessee assumes full responsibility for the vehicle from the moment of delivery until its return. The Lessee is responsible for any damages, losses, theft, fines, tolls, administrative charges, mechanical damage, interior damage, and any events occurring during the rental period.
4. Authorized Drivers
The Lessee shall be the only authorized driver of the vehicle. Lending, subleasing, or allowing third parties to drive the vehicle is strictly prohibited. Any violation will result in full liability for the Lessee.
5. Vehicle Condition
The Lessee acknowledges that the vehicle is delivered in good physical and mechanical condition. The Lessee inspects the vehicle prior to acceptance and agrees to its condition.
6. Permitted Use Of The Vehicle
The Lessee agrees to use the vehicle solely for lawful and personal purposes within permitted limits.
7. Prohibited Use Of The Vehicle
The following is prohibited:
- Smoking inside the vehicle
- Consuming alcohol or drugs
- Transporting illegal substances
- Engaging in illegal activities
- Subleasing the vehicle
- Lending the vehicle to third parties
Applicable penalties:
Smoke odor inside the vehicle: $130 USD
Burns or damage caused by smoking: $200 USD minimum
8. Vehicle Insurance
The Lessee declares that they have their own insurance or agree to assume full responsibility for any damages. Rental rates do not include insurance.
9. Security Deposit
The Lessee shall provide a minimum security deposit of $300 USD. This deposit will be refunded approximately within 72 hours after the vehicle is returned, subject to inspection.
10. Included Mileage And Additional Miles
The rental includes a mileage package. Additional miles will be charged as follows:
From 1 to 100 additional miles: $0.49 USD per mile
From 101 to 499 additional miles: $0.39 USD per mile
Over 500 additional miles: $0.35 USD per mile
11. Vehicle Cleaning
The vehicle must be returned in reasonably clean condition. In case of excessive dirt, a $40 USD cleaning fee will be applied.
12. Late Return
The Lessee has a 30-minute grace period. After that time, a charge of $20 USD will be applied for each additional hour.
13. Loss Of Keys
Loss of keys will result in forfeiture of the minimum $300 USD security deposit.
14. Towing Charge
If the vehicle requires towing due to the Lessee’s negligence, the security deposit will be forfeited or a minimum charge of $300 USD will be applied.
15. Geographic Restrictions
The Lessee may not leave the state of Texas without prior authorization. In the case of authorized travel, the minimum deposit will be $700 USD. Approaching border areas is prohibited.
16. GPS And Tracking
The vehicle is equipped with a GPS system. The Lessee authorizes monitoring during the rental period. Disconnecting the GPS will result in immediate forfeiture of the deposit.
17. Rental Extension
Any extension must be authorized in advance and paid before continuing the use of the vehicle.
18. Failure To Return The Vehicle
Failure to return the vehicle on the agreed date constitutes a breach of this Agreement. The Lessor may recover the vehicle and notify the authorities without the need to wait for additional periods.
19. Tolls And Fines
The Lessee agrees to pay all tolls, fines, and violations. An administrative fee of $47 USD will be applied for each toll or fine processed.
20. Use Of Personal Information
The Lessee authorizes the use of their personal information for verification, administrative management, and legal compliance.
21. Authorization For Use Of Personal Information
The Lessee expressly authorizes the Lessor to collect, store, process, and use the personal information provided for purposes related to car rental in Houston, Texas, including identity verification, risk assessment, contract administration, outstanding payments, and fraud prevention. The Lessee agrees that this information may be shared with insurance companies, financial institutions, and law enforcement or judicial authorities when necessary for the execution of this Agreement or in compliance with the law.
22. Authorization For Use Of Image And Photographic Record
The Lessee authorizes the Lessor to take photographs and visual records of the Lessee, the vehicle, and the delivery and return process. These images may be used for security purposes, administrative control, vehicle condition verification, and, when applicable, for informational or promotional purposes related to car rental in Houston, Texas. The Lessee agrees that such images may be used as evidence in the event of a dispute.
23. GPS Tracking And Monitoring Authorization
The Lessee acknowledges that the vehicle is equipped with GPS tracking devices. The Lessee expressly authorizes the Lessor to track the vehicle’s location throughout the rental period for purposes of security, recovery, usage control, and compliance with this Agreement. Any tampering with, disconnection of, or attempt to interfere with the GPS system will constitute a material breach of this Agreement and will result in the immediate forfeiture of the security deposit, without prejudice to any additional actions.
24. Indemnification Of The Lessor
The Lessee agrees to indemnify and hold the Lessor harmless from any claims, demands, damages, losses, or expenses arising from the use of the vehicle during the rental period. This includes third-party claims, property damage, personal injury, fines, legal costs, attorney’s fees, and any expenses related to incidents that occur while the vehicle is under the Lessee’s responsibility.
25. Limitation Of Liability Of The Lessor
The Lessor shall not be liable for indirect losses, consequential damages, loss of income, travel interruptions, personal injury, loss of belongings, or any other damages arising from the use of the vehicle. The Lessee agrees that they use the vehicle at their own risk.
26. Procedure In Case Of An Accident
In the event of an accident, the Lessee agrees to:
Notify the Lessor immediately
Call the local police
Do not abandon the vehicle
Do not admit liability
Take photos of the incident
Provide complete information about the event
Failure to follow this procedure may result in full liability for the Lessee.
27. Vehicle Abandonment
If the Lessee abandons the vehicle at any location without the Lessor’s authorization, all costs related to recovery, towing, storage, and damages will be the sole responsibility of the Lessee. The Lessor may deduct such costs from the deposit or proceed with additional charges.
28. Vehicle Recovery
The Lessor reserves the right to recover the vehicle without prior notice in the event of breach of this Agreement, non-payment, misuse, unauthorized retention, or violation of any clause. The Lessee expressly authorizes such recovery.
29. Unauthorized Retention Of The Vehicle
Failure to return the vehicle on the agreed date and time without prior authorization will be considered unauthorized retention. The Lessor may report the vehicle as not returned, initiate recovery actions, and notify the appropriate authorities without the need to wait for additional periods.
30. Administrative Charges
The Lessor may apply administrative charges for the handling of fines, tolls, vehicle recovery, and legal or administrative procedures. A minimum administrative fee of $47 USD will apply for each event, in addition to the corresponding charges.
31. Payment Disputes And Chargebacks
The Lessee agrees that any payment dispute, bank dispute, or chargeback initiated without valid grounds will constitute a breach of this Agreement. The Lessor may take legal action and report the incident to credit agencies.
32. Force Majeure
The Lessor shall not be liable for any failure to perform due to events beyond its control, including natural disasters, extreme weather conditions, emergencies, government actions, or external failures.
33. Jurisdiction And Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, United States. Any dispute shall be resolved in the appropriate courts within the State of Texas.
34. Final Acceptance Of The Agreement
The Lessee declares that they have read, understood, and accepted all the terms of this Agreement. The Lessee acknowledges that this document constitutes the entire agreement between the parties and supersedes any prior agreements.
35. Signature And Acceptance
The Lessee’s physical or electronic signature constitutes full acceptance of this car rental Agreement in Houston, Texas.
